A Safeguard (201) measure is a temporary U.S. trade remedy authorized under Section 201 of the Trade Act of 1974. The U.S. International Trade Commission (USITC) investigates whether a sudden increase in imports has caused, or threatens to cause, serious injury to a U.S. industry. If the legal requirements are met, the President may impose an import restriction to give that industry time to adjust. These measures are also called global safeguards because they can generally apply to imports from multiple countries, subject to the specific measure’s terms and exclusions.
For an importer, the measure may add an extra duty, establish a tariff-rate quota, or use another restriction listed in the official measure. This treatment is separate from the product’s normal customs duty and may apply in addition to other applicable measures. Whether it applies depends on the product’s tariff classification, country of origin, entry date, exclusions, quota status, and any special filing instructions. The importer of record is responsible for reviewing the official requirements and declaring the shipment correctly; a customs broker can help with classification and compliance questions.
What to check
- Confirm the product’s HTSUS classification, including any required statistical suffix, against the official safeguard notice or tariff schedule.
- Check the measure’s scope carefully: product descriptions, technical specifications, exclusions, country-of-origin rules, and any stated entry-date requirements.
- Determine whether the safeguard is an additional duty, tariff-rate quota, absolute quota, or another restriction, and follow the applicable entry and reporting instructions.
- Review whether other trade measures may also apply, such as ordinary customs duty, antidumping or countervailing duties, or other special tariffs; do not assume one measure replaces another.
- Keep product specifications, origin records, supplier documents, and classification analysis, and consult a licensed customs broker or trade counsel when the product’s coverage is uncertain.
