Forced-labor Section 301 — Cambodia — 10% additional duty

A Section 301 measure is a U.S. trade remedy used in response to certain acts, policies, or practices involving a foreign country that are considered unjustifiable, unreasonable, or discriminatory and that burden U.S. commerce. It may impose an additional duty on covered merchandise, on top of ordinary customs duties and other applicable trade measures. The measure record—not the title alone—controls the legal result.

For an importer, the key terms are the covered country, tariff classification (usually the HTSUS subheading), product description, country of origin, and any listed exclusions or scope limits. A product associated with Cambodia may be affected if its origin and classification fall within the measure’s coverage. Because forced-labor restrictions can also involve separate authorities, including import prohibitions, confirm whether the reference is truly a Section 301 additional duty or another forced-labor measure before entry.

What to check

• Identify the product’s correct HTSUS classification, using the product’s material, function, construction, and other classification facts.
• Confirm the product’s country of origin under U.S. origin rules; shipping from Cambodia alone may not establish origin.
• Read the official measure notice, annex, and any amendments to check the exact covered tariff provisions, scope language, exclusions, and effective provisions.
• Check whether separate forced-labor rules, such as an import prohibition or detention risk, apply in addition to any additional duty.
• Verify the importer’s entry declaration, duty calculation, and documentation with CBP guidance or a qualified customs broker when classification, origin, or scope is uncertain.
