A type 232 measure is a U.S. trade action under Section 232 of the Trade Expansion Act. It addresses imports that the U.S. government determines may affect national security. The Bureau of Industry and Security (BIS), within the Department of Commerce, administers many Section 232 measures. Depending on the measure, it may impose an additional duty, establish a tariff-rate quota, require an import authorization, or apply other conditions.
These measures typically affect importers of specified products, materials, components, or “derivative” products, sometimes only from particular countries or origins. The key issue is whether the merchandise matches the measure’s product description and the relevant Harmonized Tariff Schedule of the United States (HTSUS) classification. A product can have a normal customs duty and a separate Section 232 duty, so the measure may change the importer’s landed cost and entry-filing obligations. Classification, country-of-origin, scope, and any exclusion or quota rules may require a customs broker or trade lawyer’s judgment.
What to check
- Compare the product’s technical description, material, composition, and intended use with the measure’s scope; do not rely on the product name alone.
- Confirm the correct HTSUS subheading and check whether the measure identifies that tariff provision, a derivative product, or another defined category.
- Verify the product’s country of origin and whether the measure applies differently by origin, including any treatment for goods from particular countries.
- Review the official measure instructions for additional duty reporting, quota or authorization requirements, exclusions, and required entry data.
- Keep supporting records such as product specifications, bills of materials, origin documents, and classification analysis, and ask a qualified customs professional to resolve uncertain cases.
